Terms of service
Last updated 5 October 2026
In short: the restaurant owns its data and is responsible for its staff accounts, its tax settings and the hardware it runs RestPOS on. ESdesire runs the service, keeps it secure and supports it. Prices and plans are agreed in writing with each restaurant.
1. About these terms
These terms are an agreement between ESdesire ("we", "us") and the restaurant business that uses RestPOS by ESdesire ("RestPOS"), called "you" below. Owners, managers, cashiers, waiters and kitchen staff use RestPOS on the restaurant's behalf, and the restaurant is responsible for their use. If a separate written agreement or quote with ESdesire says something different, that agreement applies.
2. Accounts and access
- Each person should have their own account. Do not share passwords or PINs.
- You decide who has access and what each role can do, and you remove access when someone leaves.
- Keep your sign-in details safe. We recommend two-factor sign-in for owners and managers.
- Tell us at [email protected] straight away if you think an account has been misused.
3. Plans, licences and devices
- Your plan sets which features you can use and how many desktop tills, waiter phones and kitchen screens you can connect.
- Prices, billing periods and payment terms are agreed with you in writing before you start.
- Tills and phones check your licence when they connect. A desktop till can run offline for up to 30 days between check-ins; after that it needs to go online to keep working.
- If a plan ends or is not paid, devices keep working for a short grace period and then stop until the plan is renewed. Your data is not deleted because a plan has lapsed.
4. Acceptable use
You agree not to:
- use RestPOS for anything unlawful, or to record data you have no right to hold;
- try to get around licence or device limits, or copy, resell or reverse engineer the software, except where the law allows it;
- try to reach other restaurants' data, test our security without permission, or overload the service;
- send messages to customers who have not agreed to receive them.
5. Your data
- Your restaurant's data belongs to you. You let us store and process it only to provide, secure and support RestPOS for you.
- You are responsible for having a lawful reason to record your customers' and staff's details, and for telling them how you use them.
- You can ask us for an export of your data while you are a customer and for a reasonable time after you leave.
- How we handle personal data is explained in the privacy policy, and how deletion works is on the data deletion page.
6. Taxes and records
RestPOS helps you apply and report taxes, but you are responsible for choosing the right tax settings, checking your reports and filing your returns. RestPOS is not currently connected to FBR, PRA or any other tax authority's systems.
7. Services from other companies
If you connect an SMS, WhatsApp, email or payment provider, your use of that provider is under its own terms and charges. We are not responsible for services we do not run.
8. Offline use and your hardware
- You provide and look after the computers, printers, phones and network RestPOS runs on, and keep them within the supported systems listed when you install.
- Sales made offline are kept on the till until it reconnects. If a till is lost or damaged before it uploads them, those sales can be lost, so let tills reconnect regularly.
- Protect till computers with a sign-in password, because they hold a copy of your restaurant's data.
9. Availability, updates and support
- We work to keep RestPOS available and reliable, but we cannot promise it will never be interrupted. We may pause the service briefly for maintenance and try to do so outside busy hours.
- We improve RestPOS over time. Some updates are required for tills and phones to keep syncing safely, and RestPOS will tell you when an update is needed.
- Support is provided by email at [email protected] and as agreed in your plan.
10. Suspension and ending the service
- We may suspend access if payment is overdue, if these terms are seriously broken, or if we must to protect RestPOS, other restaurants or the public. Where we can, we will warn you first.
- You can stop using RestPOS by telling us in writing, subject to the term agreed for your plan.
- When the service ends, we can give you an export of your data. After that we delete it as described on the data deletion page.
11. Responsibility
We provide RestPOS with reasonable care and skill. To the extent the law allows, we are not responsible for indirect losses such as lost profit or lost business, and our total responsibility for any claim is limited to the fees you paid us for RestPOS in the 12 months before the claim. Nothing in these terms limits responsibility that cannot be limited by law.
12. Changes to these terms
We may update these terms as RestPOS changes. We will change the date at the top and tell restaurant owners about significant changes before they take effect. If you keep using RestPOS after that, the new terms apply.
